If you are weighed down by unmanageable credit card debt, being harassed and pressured by creditors or in danger of losing your home to foreclosure, a strong legal advocate can make a world of difference.

Here at the law firm of Hayden & Hart, PLLC, we provide strong counsel, support and representation for individuals and families in Beckley, and throughout the surrounding cities and counties of southern West Virginia. Our law firm advises and assists clients with both Chapter 7 and Chapter 13 bankruptcies petitions.

With over 20 years of combined experience, our attorneys can help you understand the advantages of filing bankruptcy, walk you through the requirements you have to meet, and stand up for your and your family's well-beings.

Even if you have already received a notice of foreclosure on your house, you do not need to start packing right away. Our experienced attorneys may be able to help you save your home by negotiating with your mortgage holder for alternatives to foreclosure.

Chapter 7 Bankruptcy

Sometimes referred to as "liquidation" bankruptcy, Chapter 7 allows you to erase all unsecured debts. This method is particularly helpful for people who have a significant amount of credit card debt.

In order to file a Chapter 7 bankruptcy petition, however, you must meet certain income guidelines. If your income is above the state average, the court will use a "means test" to determine your eligibility.

Chapter 13 Bankruptcy

Called a "reorganization" bankruptcy, Chapter 13 allows you to create a structured repayment plan. If you are eligible to file for Chapter 13 bankruptcy, you will typically be required to pay off as many debts as possible over a three- to five-year period.

Protection From Creditors

As soon as you file for bankruptcy, the court will issue an "automatic stay" on your behalf. The stay forces creditors to immediately stop all collection efforts, effectively preventing wage garnishments, the seizure of your property or other actions.
